MINUTES OF PLANNING AND ZONING COMMISSION MEETING

December 13, 2001

A meeting of the Westminster Planning and Zoning Commission was held in City Hall on the evening of December 13, 2001, at 7:00 p.m. Members Bair, Palmer, Beaver, and Ferguson; Chairman Wiskeman; Director of Planning and Public Works Beyard; Town Planner Siders; City Attorney Walsh; County Planner Moser; and members of the public were present.

Mr. Beyard presented Annexation No. 46 Roop's Mill. Mr. Beyard stated that the subject property is 92.85 acres and the applicant is requesting "R-10,000" Residential Zoning. Mr. Beyard stated the City is currently applying for a well permit on the property. The well is projected to yield, if permitted, 105,000 gallons of water per day and 187,000 gallons per day during the month of maximum use. Mr. Beyard stated no public comments have been received opposing this annexation. Mr. Beyard stated that staff recommends that the Commission favorably recommend Annexation No. 46 to The Mayor and Common Council its consideration. Ms. Bair asked about the status of Rockland Road being extended through the property. Mr. Beyard stated the County Commissioners have not favored the extension of Rockland Road in the past. On motion of Ms. Bair, seconded by Mrs. Palmer, the Commission voted to favorably recommend Annexation No. 46 to The Mayor and Common Council.

Mr. Walsh presented the Preliminary Plan for Furnace Hills Section 4. Mr. Walsh stated that this project was the subject of a Board of Zoning Appeals hearing in which the applicant was granted two variances for lot # 14. The variances granted a reduction in the side yard and front yard setback requirements. Mr. Martin Hill with Masonry Homes stated that rather than have the Commission consider the plan containing the proposed lot #14, he would rather have it consider a revised preliminary plan that deletes lot #14 and in its place will be a water quality pond. Mr. Hill stated that the proposed lots are approximately .25 acres. Mr. Beyard stated that Furnace Hills Sections 1,2, and 3 are in the PD-4 zoning classification and the lots are generally smaller than what is proposed in this plan. Mr. Beyard stated that staff recommends favorable action by the Commission with the conditions that all agency comments are addressed and lot #14 is deleted and replaced with a water quality pond. On motion of Ms. Bair, seconded by Mr. Beaver, the Commission conditionally approved the amended Preliminary Plan for Furnace Hills Section 4 provided all agency comments are addressed and lot #14 be deleted and replaced with a water quality pond.

Mr. Beyard stated that Mr. Siders had been promoted to the position of Town Planner with the City of Westminster.

Mr. Siders presented the site plan for BJ's Wholesale Retail Fueling Facility. Mr. Siders stated this facility will contain twelve fueling stations. Mr. Siders stated that staff recommends Conditional Approval of the site plan for BJ's Wholesale Retail Fueling Facility contingent upon agency comments being addressed. Mr. Walsh stated this plan had been the subject of a special exception hearing in front of the Board of Zoning Appeals and there had been no opposition to this plan. On motion of Mrs. Palmer, seconded by Mr. Ferguson, the Commission Conditionally Approved the site plan for BJ's Wholesale Retail Fueling Facility subject to the applicant addressing all agency comments.
On motion of Ms. Bair, seconded by Mrs. Palmer, the minutes of the November 8, 2001 Commission meeting were approved as amended.

The meeting was adjourned at 7:50 p.m. on motion of Ms. Bair, seconded by Mr. Ferguson, and duly passed.
