MINUTES OF CITY COUNCIL MEETING

CITY OF WESTMINSTER, MARYLAND
August 23, 2004

QUORUM:

A Meeting of The Mayor and Common Council was held in the City Hall Council Chambers, located at 1838 Emerald Hill Lane, on the evening of August 23, 2004 at 7:00 p.m.  Mayor Dayhoff; Council President Halstad; Council Members Albert, Chiavacci, Ferguson, and Wack; Planning and Public Works Director Beyard; City Treasurer Urban; City Attorney Walsh; and City Clerk Taylor were present.

MINUTES:

Upon Motion of Mrs. Albert, seconded by Mr. Ferguson and unanimously passed, the Minutes of the Meeting of August 9, 2004 were approved as presented.

PUBLIC HEARINGS:

Mayor Dayhoff conducted a Public Hearing on Ordinance No. 722 – Medical and Dental Offices in the R-7,500 Zone (Text Amendment No. TA04-1).  At his request, Mr. Beyard explained that the Ordinance resulted from the work of the Lower Pennsylvania Avenue Committee and the City’s Economic Summit in March, 2004.  If passed, the Ordinance would add certain nonconforming medical and dental offices to the list of principal uses in the R-7,500 Residential Zone.  There being no further comment or discussion, Mayor Dayhoff closed the Hearing at 7:05 p.m., leaving the Record open for ten days.

Mayor Dayhoff next conducted a Public Hearing on the City’s 2004 Public Housing Agency Plan.  Ms. Blandford summarized the Plan.  Mr. Chiavacci suggested that certain information be tracked.  City resident Josephine Velazquez inquired as to the source of information for certain rental unit pricing.  There being no further discussion or comment, Mayor Dayhoff closed the Hearing and the Record at 7:30 p.m.  

CONSENT CALENDAR:

Mrs. Albert moved to approve the Consent Calendar, which consisted of approval of  the July 2004 Departmental Operating Reports; operating agency approval of two amendments to the County Water and Sewer Master Plan; approval of Modification No. 5 to Agreement No. A-856 (Westminster Square); approval of a commercial lease for parking spaces in the Westminster Square Parking Deck; and acceptance and approval of the Fiscal Year 2005 City/County Agreement.   Mr. Ferguson seconded and the Motion passed unanimously.

REPORTS FROM MAYOR:

            Wished Taneytown a happy 250th birthday.

            Thanked Council Member Ferguson for attending the Grand Opening of Office Depot.

REPORTS FROM STANDING COMMITTEES:

Council President Halstad noted that a presentation of the history of the relationship between Westminster and Paide, Estonia would take place at the next Meeting of the Mayor and Common Council.

Council President Halstad advised that he would review the Rules of Order and Procedure at an upcoming Meeting.

ORDINANCES AND RESOLUTIONS:     

Council President Halstad requested Mr. Urban to summarize Resolution No. R04-7 – Eighth Amended and Restated Local Government Insurance Trust Agreement.  Afterward, Dr. Wack moved to introduce the Resolution.  Mr. Chiavacci seconded and the Motion passed unanimously.

Mr. Ferguson moved to introduce Ordinance No. 722 – Medical and Dental Offices in the R-7,500 Zone.  Mrs. Albert seconded and the Motion passed unanimously.

DEPARTMENTAL REPORTS:

Chief Spaulding reported that Lieutenant Wayne Mann had been selected to represent Westminster in Session 220 of the F.B.I. National Academy in Quantico, Virginia.  The ten-week senior management course would begin on January 10, 2005. 

Chief Spaulding noted that, since August 10, 2004, the Police issued one warning notice for illegal use of a scooter on public streets.

Mr. Beyard advised that Governor Erlich of Maryland would take 40 people on a trip to Estonia and Bosnia-Herzegovina in September.  He also noted that the National Guard would take 11 Mayors and the Director of the Maryland Municipal League to Estonia in the very near future.  The National Guard invited Mayor Dayhoff on that trip.

At Mr. Chiavacci’s suggestion, Mr. Beyard stated that he would study the volume of trash collected in the City.

Mr. Chiavacci and Mr. Beyard briefly discussed the Green Street Reconstruction Project.  Mr. Beyard reported that the Project is in the engineering and design phase and that construction is not likely to start before July 2005.       

Council President Halstad adjourned the meeting at 7:45 p.m.
